Terms & Conditions

These Terms & Conditions apply to the use of Pakenham Pickleball facilities, services, website, bookings, memberships, programs and activities.

Pakenham Pickleball is operated by Elite Indoor Sportz Pty Ltd (“Pakenham Pickleball”, “we”, “us” or “our”).

 

By making a booking, purchasing a membership, participating in an activity or using our facilities, you agree to these Terms & Conditions.

 

1. Bookings

Court bookings are subject to availability and must be made through our approved booking system or directly with Pakenham Pickleball.

 

Customers are responsible for ensuring the information provided when making a booking is accurate.

 

Bookings are for the specified court, date and time and must not exceed the booked period.

 

Players should vacate the court promptly at the end of their booking to allow the next booking to commence on time.

2. Cancellations & Refunds

Court hire, Social Play and other session bookings may be cancelled or rescheduled at least 24 hours before the scheduled start time.

 

Cancellations made less than 24 hours before the scheduled start time and no-shows are generally non-refundable.

Nothing in these Terms & Conditions excludes rights that cannot lawfully be excluded under Australian Consumer Law.

3. Court Hire

Court hire prices are charged per court unless otherwise stated.

The person making the booking is responsible for the booking and for ensuring that all participants using the court comply with these Terms & Conditions and venue rules.

Players must only use courts allocated to their booking.

4. Social Play

Social Play sessions are booked and charged per participant.

Players may be grouped or rotated between courts and other participants to provide an enjoyable and balanced Social Play experience.

Session formats, court allocation and player groupings may be adjusted by Pakenham Pickleball depending on attendance, player numbers and ability levels.

Participation in a particular game, court or player grouping cannot be guaranteed.

5. Memberships

Membership benefits apply only to the individual registered member and are not transferable.

Membership benefits may include discounted court hire, discounted Social Play, priority booking, paddle hire discounts, café/bar offers and other member benefits advertised from time to time.

Membership pricing, inclusions and benefits may vary between membership types.

 

Membership discounts cannot generally be combined with other promotions unless specifically stated.

6. Founding Membership

Founding Membership is a limited membership offer available to the first 100 eligible members, subject to availability and the conditions of the offer.

Current Founding Membership pricing is $199 annually or $19.95 per month.

Founding Member benefits apply while the applicable membership remains current and in good standing.

Pakenham Pickleball may introduce different membership products and pricing in the future without affecting amounts already paid for the member's current membership period.

7. Children & Junior Players

Children participating in Pakenham Pickleball activities must comply with any age requirements applicable to the relevant program or session.

Parents and guardians remain responsible for children in their care while at the venue except where the child is participating in a specifically supervised program under arrangements advised by Pakenham Pickleball.

Children must not be left unsupervised at the venue unless expressly permitted as part of an organised program.

8. Equipment & Paddle Hire

Players may use their own suitable pickleball equipment or hire equipment where available.

Customers are responsible for equipment hired or supplied to them.

Pakenham Pickleball may charge the customer for equipment that is lost, deliberately damaged or damaged through misuse beyond reasonable wear and tear.

9. Safety & Participation

Pickleball and other sporting activities involve inherent physical risks.

Participants are responsible for deciding whether they are physically capable of participating and should play within their abilities.

Players must follow reasonable safety instructions given by Pakenham Pickleball staff and must not participate in a manner that creates an unreasonable risk to themselves or others.

Appropriate footwear and clothing should be worn while playing.

Any hazards, injuries or damaged equipment should be reported to staff as soon as reasonably possible.

10. Conduct

We want Pakenham Pickleball to be a welcoming and enjoyable venue.

Aggressive, abusive, threatening, discriminatory, dangerous or seriously disruptive behaviour towards staff, players, spectators or other visitors will not be tolerated.

Pakenham Pickleball reserves the right to require a person to leave the venue or restrict future access where reasonably necessary for safety, security or serious/repeated breaches of venue rules.

11. Café & Licensed Bar

Food and beverages purchased at the venue must be consumed in permitted areas.

Alcohol will only be supplied and consumed in accordance with applicable Victorian liquor licensing laws and the conditions of our liquor licence.

Pakenham Pickleball and its staff reserve the right to refuse the service of alcohol where required or permitted by law.

Alcohol must not be taken onto playing courts.

12. Personal Property

Customers are responsible for their personal belongings while at the venue.

To the extent permitted by law, Pakenham Pickleball is not responsible for loss, theft or damage to personal property unless caused by circumstances for which liability cannot lawfully be excluded.

13. Venue Availability

From time to time courts or other areas of the venue may be unavailable because of maintenance, events, safety issues or circumstances outside our reasonable control.

Where we need to cancel a paid booking, we will deal with the booking in accordance with our Refund & Cancellation Policy and applicable law.

14. Photography & Video

Photography or video may occasionally be taken at the venue for promotional purposes.

Where reasonably practicable, we will advise participants when organised promotional photography or filming is taking place.

If you do not wish to appear in promotional material, please notify a staff member.

Additional consent should be obtained where required, particularly in relation to children.

15. Website & Third-Party Services

Our website and booking services may contain links to or integrate with third-party services.

Those services may operate under their own terms and privacy policies.

While we take reasonable steps to maintain our online services, we cannot guarantee uninterrupted availability of third-party systems.

16. Privacy

Personal information is handled in accordance with our Privacy Policy and applicable privacy laws.

17. Changes to These Terms

Pakenham Pickleball may update these Terms & Conditions from time to time.

The current version will be published on our website. Changes will not retrospectively remove rights that customers have under applicable law.
